- Reporting to the Regional Commercial Manager SEA, the primary objective is to manage commercial and contractual activities, including:
- Analyzing and identifying commercial, business, and contractual risks during the pre-contract tendering and joint venture development stage.
- Conducting tender commercial risk reviews and ensuring compliance with company procedures and corporate governance requirements.
- Engaging with Bid Managers, New Business & Strategy, and other relevant personnel to develop commercial strategies and frameworks for tenders.
- Working with the New Business and Strategy Team to develop strategic, commercial, and contractual responses to tenders.
- Developing key contractual arrangements with designers in consultation with Regional Commercial Manager SEA and Regional Engineering Manager SEA.
- Strategizing, developing, and negotiating key contractual arrangements, frameworks, and terms with business partners.
- Ensuring effective and consistent implementation of company commercial policies and procedures in all pre-contracts activities.
- Ensuring compliance with Tender Risk Management Procedures and driving completion of due diligence activities.
- Assisting and supporting the New Business & Strategy Team in developing strategic, commercial, and contractual responses to tenders, expressions of interest, and joint venture prospects.
- Developing contractual frameworks with key partners, including joint venture and design partners.
- Undertaking tender reviews and ensuring compliance with Commercial Operating Standards and Policies.
- Liaising with Group Legal Counsel on parent company guarantees and other legal matters relevant to pre-contract works.
- Assisting the Regional Commercial Manager SEA with tender review process and attendance at all stages of the review process for allocated tenders.
- Participating in external audits and company Peer Review processes.
- Assisting in the review of monthly project financial reports.
- Assisting in dealing with project commercial issues where supplemental support is requested by the project team.
- Providing feedback on lessons learned on tender and project commercial issues for continuous improvement.
- Relevant tertiary qualifications.
- A sound understanding of construction contracts and ancillary contracts, such as joint venture agreements.
- Demonstrated ability to analyze contractual and legal issues and provide solutions through appropriate problem-solving techniques.
- Sound commercial acumen accompanied by proven negotiation and inter-relationship skills.
- Able to quickly grasp concepts and apply innovative options to the status quo.
- Clear and definitive communication, written and verbal, accompanied by competent presentation ability.
- Tasks completed on time and to a high standard.
